Property Line Disputes

It is not uncommon for neighbors to disagree over boundaries and, when those boundaries relate to property lines, things can quickly get complicated. Although property lines may seem straightforward, issues can arise in a number of ways. For example, if a violent storm knocked over a tree that landed on your neighbor’s property or your neighbor built a structure that encroaches over the property line, some issues may arise that require legal guidance.

Different Types of Property Line Disputes

There are two main types of property line disputes you may encounter – encroaching and trespassing.

Here is what you need to know about them:

  • Encroaching: When a property owner crosses over a neighbor’s property line, this is known as encroachment. It can be a relatively simple matter, such as a branch from your neighbor’s tree crossing over into your yard, or a more complicated one, such as a fence that crosses over onto your property. If the encroachment carries on for a prolonged amount of time, it may even affect your rights to the property, which is why it is essential to address these matters quickly.
  • Trespassing: If someone enters or remains on your land without consent, it would be considered trespassing. It is not necessary that the trespasser intended to trespass. For example, a neighbor mowing near the property boundary who crosses the boundary, even if they do so unintentionally or misunderstanding the boundary, may nevertheless be a trespasser.

To solve a property line dispute, there are some steps you can take before speaking to an attorney. If talking to your neighbors or putting up signs and fences fail, however, it may be time to schedule a case review with an attorney who can help you resolve the matter. An attorney can send a cease and desist letter to your neighbor or, if necessary, file a lawsuit. Although this may sour your relationship with your neighbor, there is often no other solution to handling uncooperative neighbors who refuse to participate in working toward a more amicable resolution.
